Confirmation Hearing

Have you filed for bankruptcy protection under Chapter 13 in the Eastern District of New York state? If you have and have been assigned Michael J. Macco as your trustee, this site is designed to answer some of your questions and to provide basic information about the bankruptcy process, as well as the services Mr. Macco provides.

As a Chapter 13 trustee, he will not serve as your attorney, but will oversee the repayment of debts. He will look closely at your income and expenses, as well as your assets and liabilities, and will help you put together a manageable plan to repay your obligations. When you have legal questions or concerns, you must address those with your lawyer.

Minimizing Problems With Respect to Your Confirmation Hearing

A part of the Chapter 13 process involves the confirmation hearing. At the confirmation hearing, the bankruptcy judge will review your proposed reorganization plan and decide whether it can be approved. Before you appear in court for this hearing, though, you must submit your proposed plan to the trustee. The trustee will actually make the recommendation to the court that your plan be accepted and approved.

To make the process run as smoothly as possible, it is imperative that you and your attorney thoroughly review all claims against you and put together a plan that addresses everything. Please note that Mr. Macco requires a full week to review your proposed repayment plan before he will appear at a confirmation hearing for the plan.
